On April 22, 1999, while litigating his direct appeal, he received the 56 pages of newly discovered evidence mentioned earlier while in Superior Court. He immediately filed a 'Petition For Leave to Augment the Record' with the new evidence, but the Superior Court panel reviewing his case, on which his trial judge sat, denied the petition stating he could not augment the record with such evidence. A week or so later and well within the 60 day time limit for submitting newly discovered evidence, he revised and re-titled the petition 'Appellant's Supplemental brief containing material, exculpatory & impeachment evidence intentionally suppressed by the Commonwealth during trial and now disclosed by the FBI ', and then filed same back to Superior Court. It was duly docketed at No. 02027 PGH 98, although the Superior Court refused to address its merits. The Commonwealth filed its reply brief 74 days late and on the very day briefs were to be heard; it failed to address therein the newly discovered evidences and continued in fact its attempt to subvert Abdullah's appeal by misrepresenting facts of the police investigation and trial. The Superior Court denied relief in a memorandum convoluting the facts to distort the case. Abdullah filed a petition for relief in a PA Supreme Court attaching thereto a very damaging sworn affidavit of his initial trial counsel, Mark Rubenstein, against the trial/appeal lawyer, Mr. Kim William Riester, and the prosecutor, revealing their retraction and concealment of several previously discovered impeachment documents following Rubenstein's withdrawal from the case two weeks after the prosecution claimed that it had given defense attorney Mr. Rubenstein, by law, all police/FBI reports and/or statement evidences both favorable to and/or incriminating of Abdullah. At the PA Supreme Court level, the prosecution declined to file anything in opposition to Abdullah's claims against it. However, the PA Supreme Court on April 4, 2000 refused to review Abdullah's petition.
